TERMS AND CONDITIONS

THESE TERMS

 

1.1 These are the conditions under which we provide you with the goods that are listed on our website, www.redforrestboutique.com (the "Product(s)"). They relate to the product or products we sell to you as a customer. Before placing your order for the product or products (an "order") with us, please carefully read these terms.

 

1.2 These terms tell you who we are, how we will supply product(s) to you, how you and we may amend or end the contract, what to do if there is a problem and other relevant information.

 

INFORMATION ABOUT US

 

2.1 Red Forrest Boutique Ltd is a limited company registered in England and Wales with company number 12537477 and doing business as Red Forrest Boutique. It is the operator of this website. Our registered address is located at 15 Elm Park Road, Pinner, HA5 3LE. Red Forrest Boutique is referred to by the terms "we," "us," "our," and "RFB " throughout these Terms and Conditions.

 

2.2 You may reach us at info@redforrestboutique.com. Please provide information about your order, such as your order number, if it relates to your question so we can locate it. If necessary, we will get in touch with you via phone or in writing at the email address or mailing address you gave us when placing your order.  For the sake of clarity, emails are included in the definitions of "writing" and "written."

 

RED FORREST BOUTIQUE’s CONTRACT WITH YOU

 

3.1 You can place an order with us by following the instructions on our website. Before your order is sent to us, you can review and correct any mistakes using our order process. At every step of the order process, please take the time to read and review your order.

 

3.2 After you place an order, we could email you to let you know that we received it and are working on it. There isn't a legally enforceable contract at that point, and that email doesn't confirm that we have accepted your order.

 

3.3 Your order won't be accepted until your credit/debit card or PayPal has been fully charged. A legally binding agreement between you and us for the product or products you ordered is created when we accept your order (referred to as "the Contract").

 

3.4 We will notify you via email if we are unable to fulfil all or any portion of your order, and you won't be charged for the product or products.

 

At our sole discretion, we may also decline to process and, as a result, accept an order for any reason. Other than returning any money you have already paid for the product or products in question, we will not be liable to you for any damages if we are unable to accept your order.

 

For example, this could be because the product or products are out of stock, because we аre

unable to reasonably plan for unforeseen resource limitations, because we have discovered a mistake in the product's price, content, inventory, or description, because the product or products do not meet our quality control standards and have been withdrawn, because shipping restrictions apply, because legal restrictions prevent us from delivering to you, or because we are unable to meet a delivery deadline you have set.

 

3.5 When we ship the product or products to you, the contract will be finalised. English law will apply to the deal, which is signed in England. The only people who can sign legally binding contracts with us are adults, defined as those who are 18 years of age or older.

 

PRICE AND PAYMENT

 

4.1 Our website shall display the pricing of our product or products in GBP (UK pounds). When chosen, delivery fees will be prominently shown and added to the total price. For information on what occurs if we find a price inaccuracy in the product or products you ordered, please refer to clause 4.3.

 

4.2 When you place your order, the order pages will make it apparent if the product or products' pricing includes VAT. Unless you have already paid for the product or products in full before the change in the rate of VAT takes effect, we will modify the rate of VAT you pay if VAT is chargeable and the rate of VAT changes between the date of your order and the date we supply the product or products.

 

As mentioned in section 7.10, once international orders arrive in a jurisdiction outside of the UK, they may be subject to import or customs duties and tax charges (including VAT at the rate applicable in your country). This expense is not covered by us, so you will be liable for any additional costs.

 

4.3 It is always possible that some of the products we sell might be priced erroneously, even with our best efforts. Before accepting your order, we often check pricing. If the true price of the product or products on the day of your order is less than the price we mentioned, we will charge the lesser amount. We will get in touch with you to get your instructions before accepting your order if the correct price of the product or products on the day of your order is more than the price that was quoted to you. We may terminate the agreement, return any money you have paid, and cancel your order if there is a pricing error that is clear, unmistakable, and that you might have reasonably recognised as a mispricing.

 

4.4 Your order must be paid for online.

 

Wix.com Ltd. (abbreviated "Wix") is the company that hosts our online store. We offer our product or products to you online using e-commerce platform that Wix provides. Wix offers different payment methods and providers depending on your location.

 

In addition to the majority of major credit and debit cards and Paypal, we also accept any alternative payment methods that may occasionally be promoted on our website. By making a purchase, you are attesting that the credit/debit card or Paypal account being used is either yours or that the owner has given you express permission to use it.

 The card issuer must authorise and conduct validation checks on all credit and debit cardholders. We won't be responsible for any delays or non-delivery if the person who issued your credit card declines to authorise payment.

 

4.5 On occasion, we could provide our clients with discount coupons via email or post special offers on our website. Please be aware that you can only apply one discount code per order and one discount at a time, unless otherwise noted. Discounts only apply to the product or products' value. Only full-priced items on the website are eligible for discount codes. Discount codes are not valid beyond their expiration date, and if you neglect to enter them when placing your order, we are unable to apply them. Please be aware that if you need to return or exchange an item, the same discount that was applied to your order will be applied again. This implies that you will only receive a refund for the original purchase price.

 

INFORMATION AND IMAGES OF THE PRODUCT

 

5.1 The product(s) photographs on our website serve illustrative purposes only. Despite our best efforts, we are unable to ensure that the colours displayed on your device precisely represent true colour/hue of the product or products. Your product or products may differ slightly from those pictures. Please be aware that the gemstones we use in our products are natural and unique. These gemstones' colour and composition may differ somewhat from the picture displayed; in particular, natural gemstones may contain minute inclusions, have natural cracks or may show differently in various lighting conditions.

 

5.2 The product(s) sizes, colours, dimensions, and measurements listed on our website may not be exact, despite our best efforts to be as accurate as possible. Before placing your order on our website, please email us at info@redforrestboutique.com if you have any questions regarding the colour, size, or any other specification of the product or products you want to order.

 

5.3 The product(s) may not come in the same packaging as any of the pictures on our website.

 

5.4 You are responsible for making sure that the measurements and customisation instructions are accurate if we create any products based on measurements you provide or if we offer individualised services.

 

PRODUCT CHANGES

 

6.1 Please get in touch with us if you would like to modify the product or products you ordered. At our sole discretion we will decide if the modification is feasible, and if so, we will notify you of any modifications to the product or products' prices, the delivery schedule, or anything else that may be required as a result of your requested change. We will then ask you to confirm that you want to proceed with the adjustment.

 

6.2 We may make modest technological adjustments and enhancements to the product(s) to reflect changes in applicable laws and regulations. Your use of the product or products shouldn't be impacted by these modifications.

 

DELIVERY

 

Dispatch

 

7.1 All orders are processed as quickly as possible, and we will make every effort to deliver your product to you as soon as is practically feasible.

 

Please be aware that the type of product or products ordered will affect the shipment time. Specifically:

 

(a) Within 1 to 2 business days of your placing the order, any ready-made products that are in stock shall be shipped.

 

(b) Handmade-to-order products (which will be noted on the product page, when such an option becomes available) may take three to five weeks to ship after the acceptance notification. (c) The processing time for bespoke products can vary depending on how intricate the items are. Although a timeline will be established with you as part of the consultation process, an average period of 8–10 weeks is most likely.

 

7.2. Please get in touch with us directly at info@redforrestboutique.com if you need your order by a certain date, and we will try our best to help.

 

7.3. As soon as your product or products are shipped, you will receive an email confirming this. We will get in touch with you if there is a delay for whatever reason.

 

Delivery throughout the United Kingdom

 

7.4 UK delivery is free regardless of order value. We use Royal Mail Tracked delivery services that are secure with end-to-end tracking and SMS and/or email notifications. Delivery normally takes between 2 to 3 business days. 

 

7.5  Please be aware that Royal Mail (or any other appropriate courier that may be employed for delivery from time to time) controls all delivery times, not us. Unexpected events can impact delivery timelines. Royal Mail or any other courier we engage in this regard may create adjustments or delays, for which we are not responsible.

 

7.6 At our sole discretion, we reserve the right to alter the distribution methods that are employed.

 

Delivery Outside of the United Kingdom

 

7.7.  Orders are shipped using Royal Mail's International Tracked & Signed service, and the shipping fees are £12 to Europe and £15 to the US, Canada and the rest of the world on orders not exceeding £150. Orders exceeding £150 are shipped at the expense of Red Forrest Boutique.

 

Please be advised that there may be some destinations that we are currently unable to deliver to, and that there may be potential delivery delays due to local restrictions.

 

7.10 Please be aware that once an international order reaches a jurisdiction outside of the UK, it may be subject to import duties and taxes or customs fees. Any additional fees that may be incurred must be paid by you since we do not cover this expense. Unfortunately, we are unable to provide advice on these fees as they may differ from one country to another. Before placing your order, we encourage you to get further information from your local customs office.

 

In the case where a package is returned because the buyer does not pay customs fees, the buyer shall be responsible for the actual cost of return shipping.

 

Deliveries that are lost or delayed

 

7.11 Please get in touch with us if your delivery has been delayed, and we'll help you find it or trace it with Royal Mail or the relevant postal services. Please be aware that after the product or products have left our facility and are in the custody of Royal Mail or another courier, we are not liable for any delays.

 

7.12  We are unable to issue a refund or replace any lost products until 20 working days following the date of dispatch (30 days for international items). This is when Royal Mail considers items to be lost.

 

7.13 Please make sure that no one else at your address has received your product or products if they appear to have been delivered but you have not received them. Additionally, please make sure it hasn't been left in a designated safe area or with a neighbour.

 

Additional shipping details

 

7.14 As soon as we send the product or products to the address you provided, you will be responsible for them. Ownership of the products will not transfer until we have received complete payment, regardless of delivery or the transfer of risk.

 

7.15 We are not liable for deliveries to erroneous addresses, so please double-check your delivery address. Unfortunately, we are unable to send your package to PO Box numbers, BFPO addresses, mail-forwarding addresses, or temporary home locations because it will require a signature upon arrival.

 

 

RETURNS

 

We want Red Forest Boutique product or products to make you happy. Please get in touch with us if you have concerns or issues concerning the product or products. Our email address is info@redforrestboutique.com

 

8.1 From the time you receive the email confirming your order until 14 days following the date of delivery (the "cooling-off period"), you are free to cancel it. This implies that you can cancel the contract, return the things in their original packaging, unworn, and in good condition, and get a refund, if you decide for any other reason that you do not wish to receive or keep the items you ordered.

 Please be aware of the following exemptions:

(a) products that have been specially made to meet your needs, such as custom orders;

(b) custom-made goods, such as rings that are sized to a precise specification;

(c) pre-ordered items; or

(d) things—especially earrings—that are hygienically sensitive and cannot be resold.

 

Please email info@redforrestboutique.com before the cooling-off period ends if you would want to cancel your transaction and return things in the manner described above.

 

After that, you have a further 14 days to return the item to RED FORREST BOUTIQUE, at 15 Elm Park Road, Pinner, Middlesex, HA5 3LE, unworn, undamaged, and in its original packing. Returning unwanted orders should be done via Royal Mail, and you are responsible for paying the postage. When sending them, we advise requesting proof of postage (and ideally using a tracked carrier).

 

After receiving and reviewing your return, we will let you know whether or not the refund was authorised. If there has been a decrease in the item's value due to your handling of it, we have the right to withhold that amount from your return if needed. If your refund is authorised, you will receive an automated refund using the original payment method within 14 days of the day we receive your returned items.

 

Please keep in mind that processing and posting the refund may take some time for your bank or credit card company to process

 

FAULTY OR DAMAGED ITEMS

 

8.2 In the unlikely event that the things you ordered are defective or damaged, please email info@redforrestboutique.com as soon as possible, no later than 48 hours after delivery, with a picture of the damaged items so that we can arrange for a replacement or provide a complete refund. Additionally, items must be returned to RED FORREST BOUTIQUE, 15 Elm Park Road, Pinner, Middlesex, HA5 3LE (by Royal Mail).  Please save all of the packaging if you think your package was damaged during transportation. We might require you to send it back to us so we can file a claim with Royal Mail. Before further opening the packing, please take pictures of any damage to the outside.

 

PRODUCT GUARANTEE

9.1 All of our products are covered by a guarantee that lasts for six months from the date of purchase (the "warranty period"). If there is a problem because of a manufacturing defect, we will replace it or fix it for free during the warranty period.

 

Please email us at info@redforrestboutique.com with the specifics of the problem and pictures of the manufacturing flaw in order to schedule a repair during the warranty term. After that, we will need the item returned for evaluation. We will evaluate any products that are returned as defective because of a manufacturing flaw. Any object showing signs of deterioration that are thought to be a result of misuse will not be accepted.

 

9.2 Please take note that changes in the colour of metal patina over time are natural and are not regarded as manufacturing flaws. Equally stone cracking, chipping, or scratches are not considered as manufacturing flaws. Additionally, defects that arise after the warranty term expires are not our responsibility. In certain situations, we might be able to provide a repair service, but there will be a modest fee to cover the cost of the repair plus any shipping expenses.

 

9.3 Please be aware that if a defective jewellery item has been repaired by someone else before being returned to us, we will not cover any additional repairs that are necessary, and the warranty period will be invalid

 

9.4 The customer is in charge of handling all jewellery, including metals, finished pieces, and gemstones, with care and respect and in compliance with care recommendations provided. For tips on how to take care of your jewellery to reduce wear and tear and increase its lifespan, please refer to our section on jewellery care.

 

RIGHTS TO INTELLECTUAL PROPERTY

 

10.1 "Intellectual Property Rights" refers to the following for the purposes of this contract: rights to inventions, copyright and related rights, trade marks, business names and domain names, goodwill and the right to sue for passing off, rights in designs, database rights, rights to use and protect the confidentiality (including know-how), and all other intellectual property rights relating to the product or products and the content of this website, whether registered or unregistered, including all applications and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection that exist or will exist now or in the future in any part of the world.

 

10.2 Nothing in the contract will give you ownership of any intellectual property rights in the product or products.

 

10.3 You are not permitted to reproduce, make derivative works from, distribute, perform, display, alter, publish, transmit, transfer, sell, duplicate, or otherwise exploit any of the intellectual property rights in our products or any content on our website, in whole or in part.

 

OUR RESPONSIBILITY FOR DAMAGE AND LOSS

 

11.1 Unless otherwise prohibited by law, we will not be responsible for any indirect or consequential loss, damage, or costs that may arise in connection with our products and we will not be required to reimburse you for any money unless a refund is due under clause 8 or 12 of these terms and conditions

 

11.2 In order to buy a product or products from our website, you must abide by all applicable laws and regulations, including acquiring any import, customs, or other permits that may be require. Certain national laws may forbid the importing or exportation of one or more of our products to you. Regarding the import or export of the product or products you buy, we neither guarantee nor assume any liability.

 

11.3 Neither these terms nor conditions are meant to restrict your rights as a consumer under applicable local legislation or other statutory rights that cannot be restricted, nor to reduce our responsibility to you for any personal harm brought on by our carelessness.

 

EVENTS BEYOND OUR CONTROL

 

12.1 If an occurrence beyond our control results in a failure or delay in performance of any of our obligations under the contract, we shall not be held accountable or liable.

 

The term "event outside our control" refers to any action or occurrence that is beyond our reasonable control, such as strikes, lockouts or other third-party industrial action, civil unrest, riots, invasions, terrorist attacks or threats of terrorist attacks, war (whether declared or not), or the threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, or other natural disasters, failure of public or private telecommunications networks or any other necessary utility service, supply chain, or the inability to use railroads, ships, aeroplanes, cars, or other public or private transportation.

 

12.2 Should unforeseen circumstances arise that impact our ability to fulfil our contractual obligations: (a) To inform you, we shall get in touch with you as soon as is practically feasible; and (b) For the period of the uncontrollable incident, we will suspend our contractual duties and prolong the time frame for fulfilling them. If unforeseen circumstances interfere with our ability to deliver the product or products to you, we will work with you to set up a new delivery date once the incident has passed.

 

12.3 If an occurrence beyond our control lasts more than 30 days, you have the right to terminate the contract. Please email us to cancel. If you decide to cancel, we will reimburse the whole amount you paid, including shipping fees, and you will be required to return any applicable products you have already received (at our expense).

 

ADDITIONAL ESSENTIAL TERMS

 

13.1 We may assign to another organisation our rights and responsibilities under these Terms and Conditions. Only with our written consent may you assign your rights or duties under these conditions to another individual.

 

13.2 We have a contract with you. No one else will be able to enforce any of its provisions.

 

13.3 Should a court or administrative body of competent jurisdiction rule that any article (or portion of a clause) in these terms and conditions is unlawful, unenforceable, or invalid, the other provisions will nevertheless be in effect.

 

The clause will apply with whatever modification is required to give effect to the parties' commercial intention if any invalid, unenforceable, or illegal provision would remain valid, enforceable, or lawful if some of it were removed.

 

13.4 If we do not exercise or enforce any of these conditions of use, it does not mean that we have waived such rights or provisions.

 

Therefore, if we do not demand that you fulfil your obligations under these terms right away or if we postpone taking action against you for breaching the contract, it will not absolve you of those obligations or stop us from taking action against you later.

 

GOVERNING LAW

 

15.1English law will apply to the agreement for the purchase of the product or products through our website as well as to any disagreement or claim resulting from or related to it. The courts of England and Wales will have non-exclusive jurisdiction, as you and we both agree.
